A conference has taken place today at Fair Work Australia regarding an application by Metro seeking to revoke or suspend the right of entry for Marc Marotta, Secretary of the Locomotive Division of the Rail Tram and Bus Union, to any premises governed by Metro under the company's Franchise Agreement with the Victorian Government.
The application has been made following serious allegations against Mr Marotta which relate to threatening, aggressive, violent, bullying behaviour and intimidation.
Today's private conference was attended by both parties and presided over by Deputy President Ives.
Today's hearing reached no substantive resolution. At the conclusion of the conference, it was determined by Deputy President Ives that the matter would now proceed to a hearing at Fair Work Australia on November 22 and 23.
Metro has a responsibility and a duty of care to all of its employees and has no tolerance for any behaviour that is inappropriate.
Metro will not be making any further public comment on this matter until it reaches the next stage of legal proceedings.
